Terms of Service

1. Agreement to Terms

By accessing or using CrossPost Pro ("the Service"), operated by Cali Dream Construction ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

CrossPost Pro is a multi-platform content publishing platform that enables users to:

• Connect Social Accounts: Link multiple accounts from YouTube, TikTok, Instagram, and Facebook to a single dashboard using OAuth authentication
• Upload Content: Upload video and image content to one or more connected accounts simultaneously
• Cross-Post: Publish the same content across multiple platforms with platform-specific formatting
• Manage Metadata: Edit titles, descriptions, captions, tags, and thumbnails across platforms
• View Analytics: Access account statistics, content performance metrics, and follower data
• Schedule Posts: Schedule content to be published at optimal times across all connected platforms

3. Platform API Services

You acknowledge that CrossPost Pro accesses platform data on your behalf using OAuth 2.0 authorization. You can revoke access at any time through each platform's security settings:

• Google Security Settings (YouTube)
• TikTok Settings
• Facebook App Settings (Instagram & Facebook)

4. Account Requirements

To use CrossPost Pro, you must:

• Have valid accounts on the platforms you wish to connect (YouTube, TikTok, Instagram, Facebook)
• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Have authorization to manage any accounts you connect
• Comply with each platform's age and eligibility requirements
• Provide accurate and complete information
• Maintain the security of your account credentials

5. Acceptable Use

5.1 You Agree To:

• Use the Service only for lawful purposes
• Comply with all YouTube Terms of Service and Community Guidelines
• Only upload content you own or have rights to distribute
• Respect intellectual property rights of others
• Provide accurate metadata for your videos

5.2 You Agree NOT To:

• Upload content that violates YouTube's Community Guidelines
• Use the Service to spam, mislead, or deceive viewers
• Attempt to circumvent any security features
• Use automated systems to abuse the Service
• Impersonate others or misrepresent your identity
• Upload content that infringes copyrights or trademarks
• Upload illegal, harmful, or offensive content

6. Content Ownership and Responsibility

You retain all ownership rights to content you upload through CrossPost Pro. However:

• You are solely responsible for all content you upload
• You represent that you have all necessary rights to the content
• You grant us a limited license to process your content for the purpose of providing the Service
• We do not claim ownership of your content

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled or emergency maintenance
• Modify, suspend, or discontinue features with or without notice
• Experience downtime due to factors beyond our control (including YouTube API limitations)

We are not liable for any loss or damage resulting from service interruptions.

8. API Limitations

CrossPost Pro operates within YouTube API quota limits. This means:

• There may be daily limits on the number of uploads or API calls
• Some operations may be queued during high-usage periods
• YouTube may impose additional restrictions at any time

9. Account Suspension and Termination

We may suspend or terminate your access to CrossPost Pro:

• If you violate these Terms of Service
• If you violate YouTube's Terms of Service
• If your account is flagged for suspicious activity
• At our discretion, with or without cause, upon notice

Upon termination, we will delete your data in accordance with our Privacy Policy.

10. Intellectual Property

CrossPost Pro, including its design, features, and functionality, is owned by Cali Dream Construction and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our software
• Reverse engineer or decompile our code
• Use our trademarks without permission
• Create derivative works based on our Service

12. Limitation of Liability

To the maximum extent permitted by law, Cali Dream Construction and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Actions taken by YouTube or Google
• Content uploaded by users

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Cali Dream Construction from any claims, damages, or expenses arising from:

• Your use of the Service
• Content you upload or distribute
• Your violation of these Terms
• Your violation of any third-party rights

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Posting updated terms on this page
• Updating the "Last updated" date
• Sending email notification for material changes

Continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of San Diego County, California.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
